How are car parking enforcement agencies able to get away with this?
As you've covered Parking Eye before I thought you should know about their antics in Weymouth. They run Weymouth Old Town East car park and last Sunday I parked there, bought my pay and display ticket, duly displayed it and went about my business, returning within the time on the ticket. Now, Parking Eye does not know how much I paid for my ticket nor the time allowed, yet they have sent me a fine of £90 showing a picture of my car entering and leaving the car park with the arrival and departure time clearly shown.
I say again, they have no idea what period I paid for but claim in the fine that "By either not purchasing a valid pay and display ticket or by remaining at the car park for longer than was made permitted.... ", so they don't even know which it is. I will not be paying nor entering into correspondence with these car park thugs and will be advising the BPA, although from what I have heard they're almost certainly part of the problem. How on earth do such a bunch of cowboys have access to the DVLA records? Something needs to be done, and advising people not to pay under any circumstances, no matter how intimidating the correspondence, can only help.

Presumably this is a private carpark. From 1 October, members of the BPA gained new powers to pursue keepers of cars for these penalties unless the keeper identifies the driver who then pays, or successfully appeals to the issuer of the charge, or successfully appeals to the Independent Appeals Service or wins a case brought against him in the County Courts.
However, Schedule 4 attached to Clause 56 of the Protection of Freedoms Act is very specific about the wording on parking charge notices and any that do not conform are null and void. If a parking enforcement agency takes you to court on the basis of a ticket that does not conform, it could face criminal charges.
