Please suggest to your readers that they pay by card when using a toll road, in case of an erroneous parking charge.

I called into Norton Canes services on the M6 Toll/Expressway services in the morning en route to a meeting in Northampton, staying just long enough to makes a phone call and use the toilets and then carried on to the meeting. Because the service station is approximately halfway between Northants and Warrington where I live, I did the same thing on the way home in the evening, stopping for a coffee and to use the toilet. Three weeks later, a letter arrived via my employers (company registered car) charging me for leaving the car at the services all day (£80 reduced to £50 etc) and saying they had photo evidence to prove I had left the car there all day, giving a website to check. I did this and sure enough there was my car entering in the morning at about 09.00am and leaving approx 06.30pm. The parking company had conveniently omitted the two photos of my vehicle leaving at approximately 09.20 and arriving again at about 06.10pm.

Feeling aggrieved at this selective use of the photos, I wrote to dispute the claim and ask for a refund. Fortunately after contacting the head office at the M6 Toll road I was able to get the proof that my vehicle had passed though the toll booths (lane number/time etc) as I had paid by card. They were good enough to send a confirmation letter confirming my statement, but only as I had paid by card, if I had paid cash then they do not keep records. I hope this will be of use to readers; beware of the tactics used by parking enforcement companies, and pay the toll by card.

Simply tell them you will see them in court with your explanation where you will demand full compensation for your time lost as a result of their deliberately fraudulent attempt to pursue you for a breach of contract that never occurred. Also inform the Crown Prosecution Service of this attempted fraud. You have all the proof you need in the form of testimony from the people you had the Northampton meeting with. They will drop it like a hot stone.
