Profiterholes - making a claim from pothole damage

I've recently had two tyres ruined (sidewall damage ) and a Celica T-Sport rear spring broken. I can't pinpoint the exact event of each but I drive regularly along a badly pot-holed public road. I have 21 photos of the various pot-holes in this road.

Some have been repaired so badly that the filling has come out. My neighbour has previously reported some of the holes and reported that drivers are swerving to avoid them and are increasing the risk of accidents. I am writing to claim from the local Highways Department, but if they refuse to pay, is it worthwhile making a claim in the Small Claims Court?

Check www.fixmystreet.co.uk and www.potholes.co.uk Both these sites take reports of potholes, submit them to the relevant council, and keep a record. This gives the council no excuse for not filling them and renders them liable for any damage as a result.

You would have to be certain of which potholes damaged your car, though. You may even be accused of contributory negligence in driving down a road you already knew to be severely potholed.
