Parking in a disabled bay.

I visited my local ASDA Hypermarket on Sunday and upon finding no mother and baby spaces I parked in a disabled bay - there were over a dozen other free disabled spaces.

I had noticed in the mother and baby spaces there were vans (which can't accomodate child seats) and also two seater sports cars, again with no child seats in sight (I actually have photographic evidence of this).

When I returned to my car two hours later I had recieved a notice of a fine from Town and City. Pay £30 in 10 days or £60 if over 10.

It states that they will obtain my details from DVLA- I did not think it was legal for DVLA to do this.

My question is do I have to pay Town and City and if I dont can they obtain my details from anywhere and thus try and track me in a small claims court?

Well you admit you parked in a disabled spot thus depriving a disabled person from parking there. Who knows, a whole gang of disabled people could have shown up at the same time and one of them been prevented from parking by the presence of your car. So I think you should pay. Yes, members of the BPA can pay DVLA £2.50 to obtain your vehicle keeper details from the DVLA. It is an exemption from the Data Protection Act covered in the explanatory booklet that came with your V5C registration document. had you been done for parking for 5 minutes more than the alotted time I would have had some sympathy. But you parked on a disabled spot because it was more convenient to you and that's different.
