HGV Medical At 45

Can my employer say that I cannot return to work, due to the DVLA not sending back my HGV licence because of a problem with sight in my right eye? After phoning the DVLA they told me it was fine for me to drive until a decision was made. I am still waiting for that decision to be made, which is now eight months ongoing.

If there is any doubt about the safety of your driving your employer is obliged by Health and Safety rules to refuse to allow you to drive because if the employer allowed you and you had a crash the employer would be liable.
