Signal failure

I was driving along the road and I needed to pull over after a junction. I was always told that you must indicate when you pull over so I started to indicate as I was passing the junction and another driver pulled out and collided with my car. The insurance company is quoting Woadsworth v Gillespie as case law. Are they right?

Your case rests on precisely the point you started to indicate. If
you started to indicate past the point where you could possibly have made the left turn you win. If you started to indicate at a point before you could still have made the left turn you lose.
