Hi all,
This is a bit of a techincal/legal matter so any help would be appreciated.
My friend recently sold a used audi car. When my friend bought the car, he bought it as a Quattro model (ie 4 wheel drive) and he had no reason to doubt this. Now that he has sold it the new buyer has discovered that the car is a non quattro.
The new buyer has threatened to take him to the small claims court and get his money back. My friend his really upset by all this as he is not mechanically minded and he sold the car aS a Quattro and did not know any better!
He wants to know what is likely to happen as the matter has gone to the small claims court and what he should do..how should he deal with the matter.
Any help would be appreciated.

Well I do not mean to offend you but this all seems a bit wierd. Surely it says quattro on the V5? How you friend could not know seems beyond me, how the buyer could not know also seems beyond me however on face value:
If your friend has represented in writing that it is a quattro then case closed your friend should pay up immediately.
If your friend has not represented in writing that it is a quattro and is prepeared to lie in court that he never represented it as one then he is likely to win the case through lack of evidence.
If he is an honest man then he should pay up. He also has a claim against the guy who sold it to him again depending on proof.

If its wrong for osmeone to do it to your friend, then its wrong for your friend to do it to someone else.
However, I guess the first point is are you sure that it is not a Quattro ?

Maybe someone in the past has stuck a 'Quattro' badge on the back to impress people? Seen that sort of thing done before.

He may not have known but the fact is if he sold it as a Quattro and it's not, then it's misrepresentation and and he must refund the money.

This actually throws up all sorts of issues.
Presumably if he thought it was a quattro then he would have insured it as one? However ins companies go by the reg and their database would show exactly what model it was?
Or even worse, perhaps it is a ringed / cloned car, sold on with the identity of a quattro but a different car altogether.
Only course of action I can see is refund the money to the guy and then investigate of the previous owner / seller. If not available, then re-advertise with a correct description.

what sort of place did your friend buy it from, and how long ago.
if His seller has a case against him, he may have a case against the person who sold it to him

I think your friend hasn't a leg to stand on. Put it down to experience.

Bobby G's called it. You insure by reg number now and that will show up quattro or no so either a troll or the car is a non-quattro cloned as a quattro and possible other things too.
